Salary Not Paid in Saudi Arabia? Your Rights and How to File a Complaint

2026-07-18

If your wages are delayed or unpaid in Saudi Arabia, learn what the Wage Protection System guarantees, how to transfer your job, and how to file a complaint to recover your money.

Has your employer delayed or stopped paying your salary in Saudi Arabia? Unpaid wages are one of the most common labor problems, and the law gives you clear protection and remedies. This guide explains your rights under the Saudi Labor Law and the Wage Protection System (WPS), and the exact steps to recover your money.

Your right to be paid on time

Wages in the private sector must be paid through the Wage Protection System (Himaya), which lets the Ministry monitor whether employers pay workers correctly and on time. Delaying or withholding wages without a lawful reason is a violation that gives you the right to act — and, in some cases, to transfer your services to another employer.

What counts as a wage violation?

  • Salary not paid at all for one or more months.
  • Repeated late payment beyond the period set by the system.
  • Paying less than the agreed amount in your contract.
  • Unlawful deductions from your wage.

Can I transfer my job if my salary is unpaid?

Yes — under the labor reforms, a worker may in certain cases transfer services (naql khadamat) through the Qiwa platform without the current employer's approval, and one of those cases is delay of wages for the period defined by the regulations. Check the current conditions and periods, as they may be updated.

Steps to recover unpaid wages

  • Keep evidence: your contract, WPS records, bank statements, and any messages about your pay.
  • File an amicable settlement request through the Ministry of Human Resources and Social Development (HRSD) website or app.
  • If no settlement is reached, the case is referred to the Labor Court to claim your unpaid wages and any related dues.
  • Do not sign a release (mukhalasa) stating you received your money before you actually have — it may waive your claim.
Act promptly. Filing periods are defined by the system, and delay may affect your claim. Keeping accurate records greatly improves your chances of recovering the full amount.

Foreign and expatriate workers are protected too

The Labor Law protects all private-sector workers, Saudi and expatriate, regarding wages, working hours, leaves, and end-of-service benefits. Discrimination in basic rights based on nationality is not lawful.
